Declaration on the processing of personal data by FlexI T agency sro

When processing personal data in our company, we emphasize their protection, transparent use and full security using appropriate technical means and organizational measures. We process personal data only on the basis and to the extent permitted by the General Regulation of the European Parliament and the Council No. 2016/679 on the protection of personal data and related regulations (hereinafter referred to as "GDPR"). This also applies to all processors who process personal data in accordance with our instructions.

Below we therefore present the principles and legal grounds for processing personal data. For what purposes and for how long FlexI T agency sro processes this personal data, to whom and for what reason it may be transferred, and also what rights individuals have in connection with the processing of their personal data.

Personal data manager

FlexI T agency sro does not have an appointed data protection officer, as this obligation does not apply to the company.

Scope of personal data processing

Personal data is processed to the extent that the subject of personal data (customers of natural persons, own employees performing activities for the operation of the audited company, agency workers, i.e. own employees performing activities for customers/clients of the audited company, employees of suppliers and customers, if it is a legal entity, natural persons looking for a suitable job - job applicants) provided it to FlexI T agency in connection with the conclusion of a contractual or other legal relationship with FlexI T agency, or which FlexI T agency collected otherwise and processes it in accordance with applicable legal regulations or to fulfill the legal obligations of the controller.

Sources of personal data

  • directly from a natural person (especially own employee, agency worker, job applicant) within the framework of a contractual relationship, order and demand for services, negotiations, etc.
  • directly from a legal entity, its representative, within the framework of a contractual relationship
  • from the company website
  • biometric data, i.e. fingerprint when entering the company headquarters (attendance system)
  • out of legal obligation
  • from camera footage

Categories of personal data that are the subject of processing

  • address and identification data used for unambiguous and unmistakable identification of a natural person (e.g. name, surname, date of birth, address of permanent residence)
  • data enabling contact with a natural person (contact data - e.g. contact address, telephone number, e-mail address and other similar information)
  • other data necessary for the performance of the contract
  • personal data required by law

As part of contacting via the website (contact forms), FlexI T agency collects and processes personal identification and/or contact data (e.g. name, surname, e-mail address, telephone number, etc.), which the subject of personal data (website visitor) provides of their own free will by filling in and sending a specific form, as without their knowledge it would be impossible to process the inquiry or request. We always require and process personal data to the smallest possible extent to fulfill the defined purpose and use it exclusively for this purpose and/or to handle a specific request.

The purpose of personal data processing

FlexI T agency processes personal data of individuals for the following reasons:

  1. performance of the contract concluded by the client with FlexI T agency, primarily for the purpose of providing ordered personnel services and job placement
  2. legal obligation (e.g. Accounting Act, Value Added Tax Act, Archival and Records Service Act, Act on Emergency Measures during the COVID-19 Epidemic and on Amendments to Certain Related Acts)
  3. direct marketing (sending information about FlexI T agency services) to clients and applicants
  4. legitimate interest of the administrator (providing evidence in case of necessity to defend the rights of FlexI T agency, recordings of the camera system for the purpose of protecting property and health of persons)
  5. consent of the subject – the consent of the job seeker to the processing of personal data for the purpose of arranging a suitable job or the consent of the employee to the processing of biometric data (fingerprint in the attendance system)

With regard to these purposes, FlexI T agency processes in particular personal data that is specified in the contract or that it obtains from the individual during the performance of the contract (see the previous point Categories of personal data that are the subject of processing). The processing of the personal data of an individual for the purposes of performing the contract is a necessary requirement for the conclusion of the contract itself and the provision of performance by FlexI T agency.

Does FlexI T agency need the consent of an individual to process personal data?

FlexI T agency processes personal data according to the previous point letters a) to d) only in modes that do not require the consent of the individual.
Only according to point e) are biometric data used in the company, namely fingerprints when entering the company's headquarters (attendance records), based on the consent of employees. FlexI T agency also needs consent to the processing of the applicant's personal data for the purpose of arranging suitable employment.

How long does FlexI T agency process personal data?

FlexI T agency processes personal data of individuals for the duration of the contractual relationship. After the termination of the contract, FlexI T agency continues to store personal data if it is obliged to do so by a legal regulation. Currently, this can be up to 10 years from the termination of the contractual relationship, but as a rule, it is about 3-4 years. Another reason for storing personal data may be FlexI T agency's legal claim for the purpose of recording and recovering unpaid amounts for services provided. In the event of consent to the processing of personal data of a candidate for a suitable job, personal data is stored for 24 calendar months. After this period, personal data will be deleted unless the candidate gives FlexI T agency new consent.

Cookies files

Our websites use cookies. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and stored by the web browser. This identifier is then sent back to the server whenever the browser requests a page from the server. These are small files that are used to store and receive identifiers and other information about the computers, phones and other devices from which you visit our websites. We use these cookies to compile statistics on the traffic to these websites and to appropriately target advertising to our customers. Cookies can be either "persistent" or "sessional". Persistent cookies will be stored by the web browser and remain valid until their expiration date, unless they are deleted by the user before the expiration date. Session cookies, on the other hand, expire at the end of the user's session after closing the web browser. Cookies do not typically contain any information that uniquely identifies users, but the personal information we store about you may be linked to the information stored and retrieved from cookies.
We use Google Analytics, Facebook Pixel and Hotjar on our website to recognise your computer and monitor your use of the website. Most browsers allow you to refuse to accept cookies – for example: in Internet Explorer (version 10) you can block cookies by changing your cookie settings, which is available by clicking on “Tools”, “Internet Options”, “Privacy” and then “Advanced”; in Firefox (version 24) you can block all cookies by clicking on “Tools”, “Options”, “Privacy”, then in the drop-down menu select “Use my history settings” and uncheck the box next to “Accept cookies from sites”; and in Chrome (version 29) you can block all cookies in the “Customise and control” menu, where you can click on “Settings”, “Show advanced settings” and “Content settings” and then under the “Cookies” heading select “Block sites from setting any data”.
Blocking all cookies will have a negative impact on the usability of many websites. If you block cookies, you will not be able to use all functions on our website.
You can delete cookies already stored on your computer – for example: in Internet Explorer (version 10) you must delete cookies manually (instructions on how to do this can be found here: http://support.microsoft.com/kb/278835);
in Firefox (Version 24) you can delete cookies by clicking "Tools", "Options" and "Privacy", then selecting "Use custom history settings", clicking "Show cookies" and then clicking "Delete all cookies"; and in Chrome (Version 29) you can delete all cookies in the "Customize and control" menu, where you click "Settings", "Show advanced settings" and "Clear browsing data", and before clicking "Clear browsing data", select "Delete cookies and other site and extension data".
Deleting cookies will have a negative impact on the usability of the website.

Categories of recipients of personal data

FlexI T agency, in fulfilling its obligations and contractual obligations, exceptionally uses the services of other suppliers. If these suppliers process personal data provided to FlexI T agency, they have the status of so-called personal data processors. In such a case, the processor processes personal data according to FlexI T agency's instructions and may not use them otherwise. FlexI T agency carefully selects such suppliers and concludes a personal data processing contract with each processor, which sets out strict obligations for the processor to protect and secure personal data.
FlexI T agency may also have a legal obligation to provide personal data to government authorities in certain cases.
FlexI T agency does not transfer personal data to countries outside the EU.

Rights of natural persons - subjects of personal data

Every data subject has the right to information about the processing of personal data. FlexI T agency has summarized this information in this “Statement”. According to the GDPR, from May 25, 5, the data subject has the following rights if he or she is an identifiable natural person for FlexI T agency and proves his or her identity:

  • the right to access, correct or delete your personal data – the subject of personal data has the right to information about the purpose of processing, its scope or retention period, at the same time he has the right to only process accurate personal data that correspond to reality – this is also related to the right to possible correction of inaccurate personal data, if the purpose or legal reason on the basis of which the personal data were processed has ceased to exist, he has the right to have them deleted
  • the right to object – the subject has the opportunity to raise an objection at any time if he or she believes that the processing is in violation of legal regulations, FlexI T agency is obliged to terminate the processing of personal data if the objection is justified
  • the right to data portability – if FlexI T agency requests the subject to transfer their personal data to another administrator, it will do so to the extent requested by the subject
  • right to restriction of processing – if the processed data of the subject are inaccurate, FlexI T agency will limit their processing for the period necessary to correct or supplement them, FlexI T agency will also limit processing for the period during which it verifies that the raised objection is legitimate
  • the right to be notified of a personal data breach – this right consists of the obligation of FlexI T agency to notify the subject in accordance with legal regulations of cases where the security of the subject's personal data is breached, which results in a high risk to the rights and freedoms of the natural person concerned

These principles of personal data processing and protection are publicly available on the FlexI T agency website.
The administrator is authorized to update or change this policy. A new version will always be published on this website.
