Holidays or days of rest remind us of important national and traditional events. They are a day of rest for most professions. In exceptional cases, the employer can also order employees to perform their work during a holiday. This most often happens in operations where continuous activity of employees is necessary, such as fields of transport, work in medical and cultural facilities, animal care, etc.
For working on a holiday, the employee is entitled not only to the earned salary, but primarily to compensatory time off to the extent of the work performed in this way. This must be allowed to be used by the employee by the end of the third month following the performance of work on a holiday. Another option is a mutual agreement between the employer and the employee, where instead of compensatory leave, the employee will be provided with a supplement to the earned salary in the amount of at least 100% of the average earnings.
If the holiday falls on the employee's usual working day and the employee does not work on this day, the employee is entitled to compensation for wages or part of the wages that he missed as a result of the holiday.
If the employer in continuous operation determines the first shift to be the shift that starts , for example, on Monday at 6 am , the holiday does not start at midnight, but at 6 am and ends after 24 hours. Therefore, if the holiday falls on a Wednesday, in this case an employee who finished an eight-hour shift on Wednesday at 6 am is not entitled to a bonus, even though he worked 6 hours on the calendar day of the holiday. On the other hand, an employee who started the third shift, i.e. from 10 pm to 6 am the following day, is entitled to a bonus for work on a holiday, even though he did not work from midnight to 6 am on the day of the public holiday.
